Important: These Terms contain a binding arbitration clause and class action waiver that affect your legal rights. Please read Section 14 carefully.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.
3 Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our Services. By registering, you represent that you meet these requirements.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for:
- Maintaining the confidentiality of your account credentials

4 Subscription Plans and Payment

4.2 Billing
- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as expressly stated in these Terms
- You authorize us to charge your payment method for all applicable fees
- Failed payments may result in service suspension
4.3 Free Trials
We may offer free trials at our discretion. At the end of the trial period, your account will be automatically charged unless you cancel before the trial ends.
4.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
5 Acceptable Use Policy
You agree not to use the Services to:
- Violate any applicable laws, regulations, or third-party rights
- Send spam, unsolicited messages, or engage in harassment
- Distribute malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services for any illegal, fraudulent, or deceptive purposes
- Collect or harvest user data without consent
- Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate this policy.
6 Intellectual Property

7 AI and Machine Learning
7.1 AI-Generated Content
Our Services utilize artificial intelligence and machine learning technologies. You acknowledge that:
- AI-generated responses may not always be accurate or appropriate
- You are responsible for reviewing and approving AI-generated content before use
- AI capabilities may change as we improve our models
7.2 Training Data

10 Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES OF NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
We do not warrant that the results obtained from use of the Services will be accurate or reliable. Your use of the Services is at your sole risk.
11 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Assistica AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims arising from these Terms or the Services shall not exceed the amount paid by you in the twelve (12) months preceding the claim
- These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
12 Indemnification
You agree to indemnify, defend, and hold harmless Assistica AI, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your Content or data processed through the Services
13 Termination
13.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
13.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, if:
- You breach these Terms
- We are required to do so by law
- We discontinue the Services
- Your account has been inactive for an extended period
13.3 Effect of Termination
Upon termination, your right to use the Services ceases immediately. We may delete your data after a reasonable retention period. Provisions that by their nature should survive termination shall survive.
14 Dispute Resolution
14.1 Informal Resolution
Before filing a formal dispute, you agree to try to resolve the dispute informally by contacting us at legal@chatapp.com. We will attempt to resolve the dispute within 30 days.
14.2 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California.
14.3 Class Action Waiver
You agree that any disputes will be resolved on an individual basis and not as part of a class action, collective action, or representative action.
14.4 Exceptions
Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services.
15 General Provisions
15.1 Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
15.2 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Assistica AI.
15.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15.4 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.5 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
